The Clerk of the Circuit Court of Collier County is an independently elected Constitutional Officer and Public Trustee whose responsibilities include Accountant, Auditor, Keeper of Court and Public Records and "Watchdog" of all Public Funds. Collier County is part of the 20th Judicial Circuit of Florida.
 
The Clerk's role is defined by the Florida Constitution of 1838 and Florida Statutes to ensure a critical system of “checks and balances” to protect and serve the citizens and taxpayers of Collier County by making sure that all taxpayer dollars are spent lawfully.

The Clerk’s Office performs nearly 1,200 different constitutional and statutory functions or duties, the broadest and most diverse role of any elected public official.The Clerk’s Office ensures that all county and state programs are administered correctly, efficiently and in full public view.

Recording is the assignment of sequential "instrument" numbers to documents, as they are presented. Many different document types are recorded concerning real property mortgages, deeds, satisfactions, assignments, leases, etc., as well as documents from court cases and other sources. The recorded documents create the Official Records. The process of Recording gives "constructive notice" to the public.

 The Recording process consists of:

  • assign numbers (record the document)
  • scan document (for placement on the World Wide Web)
  • index names to create an alphabetical index to the Official Records
  • return original, recorded document to owner via postage paid envelope provided by customer or pick-up

In addition to recording the documents, the Recording department reviews documents to make sure that all requirements are met and calculates and collects any taxes (Documentary and Intangible Taxes). Documentary and Intangible Taxes are collected for the Florida Department of Revenue.

Requirements:

- Originals or certified copies may be recorded.
- Documents concerning “real property” must be notarized.
- Customer must provide a self-addressed stamped envelope for the return
  of their original documents.

Reminder concerning the legibility of printed documents

It is extremely important that the images we create and place in the Official Records are legible and of the highest quality. The quality of our images depends upon the quality of the documents that you present to us for recording.

Please ensure that the print and writing is legible and dark. It is VERY IMPORTANT that you DO NOT HIGHLIGHT text on the documents, as color shows up as black on the scanned image.

Declaration of Domicile:

This document may be recorded and is your "sworn affidavit of your intent of Florida residency". Print the form, fill it out, sign it in front of a Notary Public, and send it to the Recording Department for recording, along with appropriate fees.

The Clerk serves as Ex-Officio Clerk to the Board of County Commissioners (BCC).  As Clerk to the Board, the Minutes & Records Department is responsible for monitoring, maintaining the minutes and records for the BCC, and numerous advisory boards that report to the BCC.

This is done by various formats consisting of audio, video, microfilm, and paper copies of minutes, agendas/executive summaries and backup documentation (ordinances, resolutions, contracts, agreements, etc.).  All records are available for public access.

Court Divisions: include all areas of the Judicial system: Criminal, Civil, Traffic, Probate Juvenile ect.

Civil: provides a wide range of courts record keeping, information, financial management, child support, civil appeals, domestic violence, evictions, family law, foreclosures, jury duty and small claims. Civil's main objective is to assist the public, attorneys and the courts with their constitutional and statutory functions and duties.

The Criminal Area: handles felony, misdemeanor, infractions, criminal traffic and ordinance violations. They provide a wide range of court record keeping, information, and financial management to assist the public, attorneys and the courts in accordance with the Clerk’s constitutional and statutory functions and duties.
