Option 3 - Court

The Clerk’s office must receive your option with payment, if applicable, within 30 calendar days of the date that the officer issued the citation. Once you have chosen an option you cannot change your mind and choose another option.

How do I go about requesting a court hearing to contest my citation?

You must complete and submit a Traffic Citation Option form to the Traffic Department.
 

What are the consequences of requesting a court hearing?

When you request a court hearing, you give up your right to pay the civil penalty amount and to elect the driving school option.
 
The judge may find you “not guilty” and dismiss your case, however, the judge may also fine you up to $1,000.00, plus court costs, in some cases, and also order you to attend the Basic Driver Improvement Course.
 

What if I cannot appear  in person at the court hearing?

You must complete a Traffic Citiation Option form and check "Request Court Hearing" and "by mail" and submit it to the Traffic Department.

The Clerk’s Office will send you an Affidavit of Defense which must be completed and notarized, and returned to the Traffic Department.

The judge will read the Affidavit of Defense in the courtroom. The officer and any witnesses will testify and the judge will make a decision. The Clerk’s office will notify you of the disposition of your citation via mail.
 


What if I request a court hearing and can not attend on the date the hearing is scheduled?

Each party in a court case can request one continuance. The Clerk’s office must receive the Request for a Continuance at least 7 days before the court date. The Clerk’s Office will notify each party of the new court date. 

If a request for a continuance is received less than 7 days before the court date, it will be granted ONLY in the case of a medical emergency, death in the family, or a last minute court date with a higher court.
