The Clerk of the Circuit Court as Public Trustee was established by the Florida Constitution of 1838.
Chapter 28 of the Florida Statutes defines the responsibilities of the Clerk of the Circuit Court as follows:
| - Serves as Clerk and Accountant to the Collier County Board of County Commissioners, (BCC) including keeping the minutes of BCC meetings and acting as the custodian of all county funds.
- Maintains all records, judgments and orders for civil and criminal court matters, including keeping a progress docket which notes the filing of each pleading, motion, paper or any other proceedings before the Court.
- Keeps “Official Records” which includes recording documents such as deeds, leases, bills of sale, mortgages, notices of lien, notice of levy, tax warrants and other instruments relating to ownership, transfer or claims against real or personal property, as well as Probate.
- The Clerk also provides “certified” copies of court judgments, releases of liens, and death certificates.
