Dwight E. Brock, Clerk of the Circuit Court of Collier County, announced that effective July 1, 2007, the Clerk’s Office implemented a Domestic Violence Leave Policy, as established by Florida Statute, 741.313, Chapter 2007-107.
This policy is in accordance with a newly established Florida Statute permitting employees to use up to 3 days of leave in a 12 month period, if the employee or a family or household member of the employee is the victim of domestic violence.
The Clerk’s Office new policy describes the types of actions for which this category of leave can be utilized, defines “family or household member,” the notice requirements, and states that employees utilizing leave under this policy shall use paid leave (personal, compensatory, vacation or sick leave, in that order) if available, prior to being in an unpaid status.
This new act relating to domestic violence leave applies to any employer who employs 50 or more employees and to an employee who has been employed by the employer for 3 or more months.
